Dunkin’ Donuts franchise sues food truck maker for $2.2M

A San Diego, California, Dunkin’ Donuts franchise is suing a Rochester, New York-based food truck manufacturer, M Design Vehicles, claiming the manufacturer delivered a defective food truck, according to the Democrat &Chronicle.

The plaintiff, Burton Restaurants, is seeking $200,000 and $2 million in punitive damages.

The plaintiff claims it retained the manufacturer to build the truck to San Diego County health and fire standards.

The suit claims M Design delivered the truck late and with defects.

When Burton Restaurants advised Ian MacDonald, who owns M Design with his wife, Maggie Tobin, MacDonald came to San Diego and hired a food truck repair firm to address the problems, the complaint states. MacDonald, according to the complaint, left a deposit with the repair company but failed to pay the balance needed to release the truck.

The truck did not conform to regulations and Burton Restaurants could not afford the necessary repairs, the complaint states.

Burton Restaurants declined to comment.

MacDonald said his company built the truck and that it was in service for a year before failing to pass a California inspection. He confirmed he hired a repair company and still owes that company money. He said he has not been served papers for the lawsuit.
