Is CBD legal?
The 2018 Farm Bill removed hemp from the Controlled Substances Act’s legal definition of marijuana. This made federally legal CBD-derived hemp products with less than 0.3% THC. However, CBD products containing more than 0.3% THC continue to fall under the legal definition of marijuana, making them illegal at the federal level but legal in some states. Especially when traveling, be sure to research local laws. Also, keep in mind that the FDA has not approved CBD products available without a prescription, and that some products may be incorrectly labeled.
